Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Arkan Capital Advisors, a joint-stock company incorporated in the Kingdom of Saudi Arabia and licensed by the Capital Market Authority (CMA License 23-09871) ("Arkan"). They govern your access to and use of the arkanlimited.com website, any sub-domains, the secure client portal and any related digital services (collectively, the "Services").

By accessing the Services you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Risk Disclosures and AML & KYC Policy.

The Services are intended for residents of the Kingdom of Saudi Arabia and for non-residents permitted to invest in Saudi capital markets under applicable law. You must be at least eighteen (18) years of age and have the legal capacity to enter into binding agreements. The Services are not directed at any person in any jurisdiction where such use would be contrary to local law or regulation.

Information published on the Services is for general information only. It does not constitute investment advice, a personal recommendation, or an offer of any service within the meaning of the CMA Authorised Persons Regulations. Personalised investment advice is provided only under a written advisory agreement following a documented suitability assessment.

Nothing on the Services constitutes an offer, solicitation or invitation to subscribe for, buy or sell any security, fund unit, sukuk, or financial instrument, nor to enter into any transaction in any jurisdiction in which such an offer would be unlawful.

Access to certain areas, including the client portal, requires authentication. You are responsible for safeguarding your credentials and for any activity conducted under your account. You agree to enable multi-factor authentication, to log out at the end of each session, and to notify us immediately at security@arkanlimited.com of any suspected unauthorised access. We may suspend or terminate access where we reasonably suspect compromise, fraud, or breach of these Terms.

You agree not to:

• Use the Services for any unlawful, fraudulent, or abusive purpose.
• Attempt to gain unauthorised access to any part of the Services or any related infrastructure.
• Interfere with or disrupt the integrity, security or performance of the Services.
• Scrape, copy, distribute, or commercially exploit any content without our prior written consent.
• Upload viruses, malware, or other malicious code.

All trademarks, logos, designs, text, images, research notes, calculators and software on the Services are owned by Arkan or its licensors and are protected by Saudi and international intellectual-property laws. You are granted a limited, revocable, non-exclusive licence to access and use the Services for your personal, non-commercial use. All other rights are reserved.

The Services may include market data, indices or links provided by third parties (for example, Tadawul and licensed data vendors). Such content is provided "as is" and Arkan does not guarantee its accuracy, completeness or timeliness, and accepts no responsibility for the content of any third-party site.

The Services are provided on an "as available" basis without warranty of any kind. To the maximum extent permitted by Saudi law, Arkan disclaims all liability for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of data, or loss of opportunity, arising from your use of, or inability to use, the Services. Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded.

You agree to indemnify and hold harmless Arkan, its officers, directors, employees and agents from any claim, demand or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your misuse of the Services.

These Terms are governed by, and construed in accordance with, the laws and regulations in force in the Kingdom of Saudi Arabia, including Shariah principles as applied by the competent courts. Disputes that cannot be resolved amicably shall be referred to the Committee for the Resolution of Securities Disputes (CRSD) or to the competent courts in Riyadh, as appropriate.

We may amend these Terms from time to time. Material changes will be notified through the Services or by email, and the "Last updated" date above will be revised.
